Application

1.      There Terms and Conditions will apply to the purchase of the goods by you (the Customer or you). We are Moliuliu’s Store with email address info@moliuliustore.co.uk; (the Suppliers or us or we).

2.      These are the terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions.

Interpretation

3.      Consumer means an individual acting for purposes which are wholly or mainly outside their trade, business, craft or professions;

4.      Delivery Location means the Supplier’s premises or other location where the Goods are to be supplied, as set out in the Order;

5.      Durable Medium means paper or email, or any other medium that allows information to be addressed personally to the recipient enables the recipient to store the information in a way accessible for future reference for a period that is long enough for the purpose of the information, and allows the unchanged reproduction of the information stored:

6.      Goods mean the goods advertised on the Website that we supply to you of the number and description as set out in the Order;

7.      Order means the Customer’s order for the Goods from the supplier as submitted following the step by step process set out on the Website;

8.      Privacy Policy mean the terms which set out how we will deal with confidential and personal information received from you via the Website;

9.      Website means our website moliuliustore.co.uk on which the Goods are advertised.

Use of the Website

10.   Accuracy of Content

We reserve the right of change the content of the Website at any time. We make no representations, warranties or guarantees that the contact on the Website will be free from errors or omissions.

11.   Data

All rights (including any intellectual property rights) in any data on the Website or any part of the Website which is provided by us are owned by us. You agree that you are not allowed to use the Date, or permit any third party to use it, without our permission.

12.   Privacy Policy

All personal information, including the collection of cookies, is dealt with in accordance with our Privacy Policy

13.   Personal Information and Registration

When registering to use the Website you must set up a username and password. You remain responsible for all actions taken under the chosen username and password and undertake not to disclose your username and password to anyone else and keep them secret.

               We retain and use all information strictly under the Privacy Policy.

We may contact you by using email or other electronic commutation methods and you expressly agree to this.

Basic of Sale

14.   The description of the Goods in our website does not constitute a contractual offer to sell the Goods. When an order has been submitted on the Website, we can reject it for any reason, although we will try to tell you the reason without delay.

15.   The Order process is set out on the Website. Each step allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly.

Price and Payment

16.   The price of the Goods and any additional delivery or other charges is that set out on the Website at the date of the Order.

17.   Prices and charge include VAT at the rate applicable at the time of Order.

18.   You must pay for your order in pound sterling using a UK based credit or debit card. We reserve the right to refuse to accept certain payment cards form time to time without notice.

19.   We reserve the right to change prices on the Website at any time without notice to you. If within 7 days of you placing your order on the Website, a pricing error is found in respect of any of the Goods you have ordered but which have not yet been dispatched, we will notify you as soon as possible and offer you the option of cancelling the order for the mispriced Goods or placing a new order at the correct price of the mispriced Goods.

Delivery

20.   We will deliver the Goods, to the Delivery Location by the time or within the agreed period or, failing any agreement, without undue delay and, in any event, not more than 30 days after the day on which the Order is placed.

21.   In any case, regardless of events beyond our control, if we do not deliver the Goods on time, we will refund the undelivered Goods payment to you.

22.   You agree we may deliver the Goods in instalments if we suffer a shortage of stock or other genuine and fair reason, subject to the above provisions and provided you are not liable for extra charges.

23.   If you or your nominee fail, through no fault of ours, to take delivery of the Goods at the Delivery Location, we may charge the reasonable costs of storing and redelivering them.

24.   The goods will become your responsibility from the completion of delivery or Customer Collection. You must, if reasonably practicable, examine the Goods before accepting them.

25.   A signature may sometimes be required at delivery. By placing an order, you are authorizing us to accept signature from another person at the same address on your behalf if you are not present at the time of delivery. We are not responsible for any damage of the frozen/ chilled products due to re-arrangement of delivery or your are not at home to received the parcel.

26.   For some Goods that do not require a signature at delivery you may be able to give instructions of leaving the Goods in an alternative location. We are not responsible for any parcel missing if you gave instructions to third-party couriers to leave parcel in an alternative location.

Risk and Title

27.   Risk of damage to, or loss of, any goods will pass to you when the Goods are delivered to you. You do not own the Goods until we have received payment in Full.

Cancellation and Returns

28.   If you wish to cancel an order prior to delivery you can do this by contacting us by email. If at the time of cancellation, the Goods has not been dispatched we will cancel the order and full price paid will be refunded to you. IF the Goods has already been dispatched, the cost of your order will be refunded once you returned the parcel to us within 14 days of receiving delivery. The cost of any delivery charge to you will be deducted from total amount.

29.   If you discover any of the Goods is damaged within the first 3 calendar days of delivery, you may return it and request either a full refund or replacement. If you discover the Goods  is damaged after 3 calendar days from delivery, we are not responsible and it may not be returned.

30.   If you are posting the Goods back to us we recommend that you obtain a proof of posting receipt. We will not be responsible for your costs of returning the Goods unless they are permitted by these terms.

31.   Once we have received your product or refund decision has been made, we will refund your money in the same way you initially paid for it. Refund will be made within 14 working days of receiving the Goods back. Refunds may take an additional 1-2 working days to appear in your account depending on the bank you use.  

General Provisions

32.   Entire agreement

There Terms and Conditions regulate the supply of goods to you by us. Any other terms, conditions or representations (other than those made fraudulently or implied by statue) are excluded

33.   Non-waiver of future right to enforce

The failure of us to take any action in respect of a breach of these Terms and Conditions shall not waive our right to enforce them in the future and we reserve our rights in respect of there Terms and Conditions at all times.

34.   Our liability

If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer as a result of our breach and to the extent that they are a foreseeable consequence of both of us at the time you placed the relevant order.

35.   Limitation of liability      

Our liability to you in connection with any order will not exceed the total price charged for the Goods.

36.   Transfer of Rights

You may not transfer any of your rights under these Terms and Conditions to any third parties. We may transfer our rights under these Terms and Conditions to another business where re reasonably believe your rights will not be affected

37.   Reserve the right to amend Terms and Conditions

We reserve the right to amend these Terms and Conditions at any time.

38.   Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

Using Product Information

39.   All product information (including ingredients and product photo) listed on the Website may not be up to date. This is due to change of packaging from time to time. Information provided on packaging may vary per batch. Must refer to the product itself for up to date details.
